Update 30th May 2008: The Yadav brothers have been indicted with a life sentence. A closure for Neelam Kataras legal journey towards justice for her son Nitishs gruesome death? Not really.. for two glaring reasons. First D.P. yadav the politician father has pledged to go to the higher courts for relief. Second, as things stand today a life sentence even though it denotes ‘life’ and not 14 years as was prevalent till a couple of years ago, is actually a euphemism. For the rich and powerful, the sentence once it is in the hands of the State govts can be commuted, lessened and lead to remission on various grounds.

Neelam katara expressed displeasure on the sentence. She was expecting the death penalty not out of a sense of vengeance but if at all deterrence was the raison d’etre of this long battle, then a lifer in this case was a mockery. Nitish was abducted, his private parts mutilated and then he was set afire. This was not categorised as ‘rarest of rare’ case since it was almost dubbed as ‘honor killing’..a crime of passion for the love of a sister. Makes one wonder if we are living in the Middle ages !

The battle has been won but the war is certainly not over as yet for Neelam . Although the guilty have been sentenced, they have not been subjugated, if body language is tell tale .

Bharati yadav has arrived in India from Britain to offer solidarity. Contrary to all expectations she has declared her brothers to be innocent and termed this a political conspiracy against her family. Is this a case of being worldly wise or one where she has been tormented to the degree that her will, life, words are not her own. We will never know. Since it was through a telephone call to the journalist that this message was conveyed, aspersions have been cast on the identity of the caller. Was it in actuality Bharati or someone posing as her? In any case the heroine is Neelam katara..she has won the hearts of millions of Indians …at the cost of losing her son to such a brutal death.

Update 28th May 2008: The verdict is out. The Yadav brothers Vikas and Vishal have been pronounced guilty. Neelam Katara has been vindicated, a satisfied mother, as can possibly be under the circumstances. Bharati has lost all..her family her love and her credibility. This is a landmark judgement. Justice does prevail and is not a hand maiden to the rich and powerful. Despite strong attempts by the Yadavs to escape scott free, persistent and relentless hammerstrokes by the media, citizens and Neelam, law was forced to elongate its steely grip and nail the culprits. Kudos !!

This is the third in the triumvirate of cases the other two being Jessica Lall and Priyadarshini Mattoo where middle class citizens unflinchingly took on the power manic offenders and WON.

It would make a tear jerker for sure were it to be made for the big screen. However, Bharati Yadav is in an unenviable position today.. that of a woman who has had to bear the gruesome murder of her beloved. As if that was not enough, she is the sister of the alleged murderers, as key witness is therefore expected to testify against them.

Nitish Katara. a handsome eligible, proficient young man, made the blunder of falling in love with Bharati Yadav, the daughter of a powerful politician/don from Uttar Pradesh, D.P. Yadav. Her brothers resented the match for reasons as clichéd as every other Bollywood film..class disparity. Love however, pays no heed to such obstacles. Or maybe it is that a couple in love goes through life with blinkers and rose colored spectacles, tinted to an extent that blood shot eyes of the world do not appear menacing or threatening.

No wonder then that the two carried on for four years living in the magic of their own world, oblivious to the cruel machinations under way,allegedly plotted by none other than her own brothers.

At the wedding reception of a common friend where they were both invited, they spent an enjoyable evening well into the night, celebrating, dancing, frolicking in carefree abandon, without the faintest clue that this was their last night together..nay last few minutes.

According to press reports, Bharatis brother Vikas Yadav, who Nitish had met on earlier occasions as well, under a pretext got him to leave with his cronies and himself. Nitish was never seen alive again. His badly burnt body was found a few days later, which his mother Neelam Katara recognized by his wrist watch.

In a rare display of fortitude and strength, Neelam vowed to bring the culprits to book. That she was up against a formidable foe and dangerous enemy was something she was not allowed to forget..but it did not deter her resolution. What she remembered was the gruesomeness of her sons death and she would not let them forget that either.

Running from pillar to post for justice for the last five years, exhausting resources of time, energy, money and emotions, she kept up her lone battle. As if fate was tempting her to evaluate her mettle, she lost her husband a few years after Nitishs death. But this brave woman a picture of dignity,quiet resoluteness, and determinantion took the Yadavs head on.

Bharati, the key witness, who till a few days after Nitishs death was alleged to have kept contact with Neelam, disappeared from the scene, whisked away to U.K, under strict vigilance. Despite repeated summons from the court, she failed to/was not allowed to return to India, even at the risk of being called an ‘absconder’.

Neelam katara, was hopeful that Bharati, would depose in favour of truth and her sons murder would be finally avenged. The day finally dawned yesterday when amid tight security, in-camera proceedings and hush hush arrivals, Bharati deposed before the court through simple ‘yes’ and ‘no’ to a few questions.Funny how life finally comes down to a nod this way or that..make or break!

It was made conditional from Yadavs lawyers, that from Neelams side she was the only person allowed to be present, that too after Neelam insisted..what was Bharati afraid of facing or rather who? The family of her ‘good friend’ or her cowardice.

Fom what one gets to hear, Bharati has refuted claims of any relationship theory with Nitish thereby eliminating ‘motive’ and has therefore turned a hostile witness.

Can we blame her? Its easy to get all philosophical and idealistic at such times and wax eloquent on ‘justice’ ‘love’ and ‘truth’ ‘integrity’..the list is endless. But one is not quite sure.

Its unimaginable the anguish, turmoil, dilemma Bharati finds herself in. The fact that she has been brought up in a feudalistic household is as clear as day. How can we as mere onlookers fathom the extent to which her life is controlled, monitored, programmed by her family? That her future is bleak both emotionally, and physically is apparent from the basic logistics of the situation. She was/is a loser from every aspect..caught in the trap of fiendish choices!

Had she implicated her brothers she would have melted under the guilt of her familys wrath and accusations. Now that she has not, she is going to die a thousand deaths perhaps, remembering, recounting days with Nitish, his mothers lone fight, and her stance which did nothing to appease anyone, neither her conscience nor her spirit.

‘Agle janam mohe bitiya na ki jo’.had quoted it on another story in a different perspective..but on hindsight find the cry to be arising from the same heart which pleads release from the curse of being born a daughter..punished for being born one and denied rights, even that of falling in love.

Nonetheless her efforts at covering her tracks proved futile.

Its only obvious that the last few paras, after my post too have been a quick copy paste job.. But I am just not inclined to playing detective any further to this abominable act..Horrendous.

All she should have done , if copy pasting was such a compulsion, was quote the source. That is what the CC license says. But she wanted to pass it off as her work..which is unethical.

Plagiarising is a serious offence apart from being reprehensible and therefore opine that offenders need to be exposed.

But now I think you have a point..she is in shit street.Only the wearer knows where the shoe pinches.only she knows the pain and turmoil she must have faced.She has lost everything..for being a daughter!!!

  5. come on.. dunno wat ripples or waves might have ripped thru her brain box, her heart n soul… whatever she had chosen to stand by, or lose or erase… wat i see, is just about an abuse! an abuse of love! jokes apart! i mean maybe its not the ‘umrao jaan’ concept.. till death do us apart et all.. but such happenings just make we wonder whether love is like some magic portion, only for a blessed few??!

    whether she saved her family, whether shez chicken hearted… where do we stand now to acertain that?? with just a mother of a murdered son???!!
    the strange reactionz of love hurt people, but sumtimes it just washes the soul away… maybe its just a curse from another planet!

Bharti Yadav has to decide between a life of intimidation under a family dying a thousand deaths by turning her back on the death of Nitish Katara, or, wake up and try to swerve her life in the direction she wants to steer it in. We must remember it is 2006 – she has the choice of estranging her family and standing up on her own two feet. She might have to sacrifice a comfort or two but I’m sure it will earn her better sleep everynight. We all have the courage to make the “right” decision, but usually the “right” decision involves some sacrifice on our own part – which, most of us have trouble giving.

Simi, the electronic media had been continuously airing interviews of Neelam Katara, Nitish’s mother where she has expressed in no uncertain terms how it was Bharati who coerced her to file a police complaint after Nitish went missing , against her father and brothers. She seemed totally ‘in’ with Neelam and had written to Nitishs younger brother as well stating her fears, her destitution, her solidarity and whatever. In short, she did all that was expected of her in the circumstances.

    Soon after, she disappeared. It was obviously her sympathetic stance towards the Katara family which had amounted to her being a virtual prisoner of the Yadav family all of these years…God knows in what conditions. Ofcourse since we are not privy to details of her circumstances, its difficult to gage with surety..but if her altered stand is any indication, we can fathom that she is under pressure.

    However what is amply clear is the fact that she knew of her brothers and familys disapproval and was cognisant of their methods, or rather modus operandi. It would have been ‘ideal’ if she had adopted the stand you suggest, but then idealism is rare and conditions conducive in support, rarer.

    I doubt she could have had a good nights sleep in any case..condemning her family to the gallows would have weighed down heavily as well.Its actually a bit like ‘Sophies Choice’.. doomed to excruciating anguish either way.

  12. Bharati Yadav’s act has left women kind disgraced, for who doesn’t have the courage to stand by her emotions can not stand for anyone else in world. The only question that’s whirling around my mind from last 6 years is what would be nitish’s soul feeling after she denied the relation with him. Wouldn’t her mother feeling that he sacrificed his life for a wrong person. If she could deny everything, I believe that she must be a part of the plot to get him killed also. Can this be ruled out?
    Love when rationalized doesn’t remain love anymore. As people have mentioned above that she has lost everything, I ask if she has lost everything, now what’s there to lose? why couldn’t she fight for justice for her beloved who is no more in this world just for the reason that he loved her?

    What should i say, a brilliant piece with words being put together as perfectly as beads? or should i say that a poetic assessment of situation so brutal. Doesnt matter, its a wonderful work and you should be applauded for it.
    I, However, believe in a different world. Good that the justice was given, extremly good for a mother to have got it, even so better for the society. We should rejoice in it? isnt that.. and forget that i took 6 years to give justice on an open and shut case. also forget that Bharti was indeed absconding until court “threatened” her to be declared absconder… yadavs almost succeeded but for the perseverence of the mother. This case is not to be rejoiced, rather all you dignatories, please do not forget that had Ms Neelima had been under some ailments, yadavs wouldve succeeded.

    The Drama called Indian Judiciary… ha.. nothing more then a place where justice can be delayed at ones will…

  16. I see your point Deepak..Justice delayed is justice denied..but yet again ‘better late than never’. It surely is a test of ones mental strength and personal mettle. But if one is to be positive then lets hope this verdict will act as a precedent for various other cases languishing in courts due to power play.

  17. It is all about expectations! In our country we do not expect that poor (atleast relatively), less connected (again relatively since it is MP’s son vs IAS officer’s son) people would get justice, therefore if they do get justice we want to rejoice.

    But should not we ALWAYS expect that police and politicians and the judiciary would work for the truth. Justice is not a favor dolled out by the powerful, its our right!!!! Judiciary did what it was supposed to do.

    STOP REJOICING START DEMANDING! Enough said!

  18. Pankaj, if expectations were angels , justice would be heavenly ( borrowing heavily from the adage..if wishes were horses beggars would fly)

    It is not expectation that is in the dock here. It is experience which has unfolded that justice in India is not something one can take as ones right. You have to FIGHT for it .What we are celebrating is not the ‘doling out’ of justice but at least what I am commending is the indomitable strength of Neelam katara. Had she not relentlessly carried on, stoically , unfazed, overcoming every impediment with grit, perhaps the darker forces of money and muscle power might have held sway.

    There are too many factors at work in the judicial system. From the looks of it, you are not stationed here, or the sense of Utopia where you aver ‘demanding justice’ may not have thus been a thought deserving expression.

    I live here and know from personal experience that Justice in India is a battle that can sap you, drain you and sometimes kill you. Its not the judiciary, but the peripheral factors, police reports, lawyers, corruption that make a huge negative impact.

    Several lacuna exist. But since we are part of the system that colluded in creating them, indirectly maybe, we have therefore to fight it from within. Which is what Neelam did, as before her the Jessica laLL, and Priyadarshini matoo cases.The media like a curates egg, played a large role in creating public awareness as much as we bloggers did in creating a furore. …when it all began with Jessica’s case.

  23. Come to think of it, what exactly did this moron Yadav gain out of this whole episode?
    He destroyed two young lives, got his family a lot of bad publicity and is now in the cooler for a long innings.
    Bharti is now 30 and for all the money and muscle power her dad has at his disposal,
    she can never get back the happiness she would have got from Nitish.
    It’s more than clear Bharti has lost her zest for life. In the video where she denies
    her relationship with Nitish, she looks like someone who has had enough of life.
    It’s so sad to see a once gregarious girl reduced to such a state.
    I hope there is never another such case in our country.

  24. Taking lives and bad publicity doesn’t matter at all for such people. And i take bharati to be equally guilty in all this episode. If she would have opened her eyes and saw the henious ways of her family, shown the courage to stand against her brothers for the sake of her love so that no such brother could again think of doing such a thing, she would have been much more satisfied today. But expecting this from someone who has been born and brought up in that family is probabily the mistake I am doing. Yet I thought love could make her do that, but again people worthy of true love are rare. What is that love which could not stood the stringent test of society. Better not to love.

  25. Joseph (Comment 23)… the latest update of Bharati Yadav’s grand wedding, the video of which has been aired on national TV, proves otherwise! She seems to now be ‘happily'(yes, she is clearly happy in the video) married off by her own family to yet another Yadav. Her ‘proud’ brother attended the wedding too, having gotten parole for this purpose! The grandiose wedding festivities with its celebrity guests, made me want to puke for a minute! I do not know to what extent she could have been programmed by her family… but all I know is, inspite of wholly giving her the benefit of doubt and sympathy more than what one would feel like giving her… to me it was common sense that if she had anything pricking her mind at that moment she would not be playing the silly game of resisting the garland, as if it was so funny on this occasion!

    Look, I am not saying she should not get married! After all, she is no criminal, and deserves to move on! But, it was those grand vulgar celebrations, with all those fancy guests, their ‘richness’ exhibited and that fat pig of a brother smiling away to glory, that bothered me! Me, who has never even known Nitish or any of his friends or family personally! So, would all this not have bothered Bharati? Even if it slightly did, would there not be atleast a tiny trace of it seen on her face or her behavior? Just a tiny bit!

    Didn’t Nitish deserve to stay alive, and get married with a smile on his face too?

    How I wish, Vikas Yadav was sentenced to death, and had been executed by now!

I am ashamed of her and also people supporting her deeds for various reasons.Crime remains crime, lie remains lie.She was gut less to walk away with but what about us?? why we are in so much of pity with her?? She had two paths to walk on, she chosed the easiest one..tougher one would have been to stand by justice which unfortunately did not do….reasons are im material if you do not stand for someones right and justice.Why was she not punished i am still surprised and stunned!!! there is no justice and values ..neither in judiciary nor within human being.But i have faith our deeds come back to us and so will all face the repercussion of same.

  27. I feel Bharti didnt deserve Nitish. It happens with many people like us, who fail to choose a person correctly. Its a famous saying that “Love is blind”. What I learn from this case is “Keep ur eyes open while loving someone”. Love is a God’s gift, dont waste it on unworthy people.

  28. Whatever i heard or read , i can say that girl was equally involved in that mishappening ,i mean if she was actually in love then how could she pursue her life so easily. We people are getting furious without even knowing the yadav and katara family then how could that girl who was in love, accept the dead body (that too in a very horrible and pathetic situation )of her love. If she was actually in love but forced to say no to all the deeds of her brothers then she should have committed suicide, but the truth was that the girl was not in love. Think that way, if u people will get indulge into any true relationship likewise friendship, love etc and whom with you are in relation that person goes away from you or your city without telling you the reason then for the time being you will get restless and its obvious then how could Bharti was very much relaxed and even too after knowing the fact that the guy has been murdered because he was in very much love with her, there are two reasons of that, one she is insane or else she got herself courageous to look forward but i thing that is not courage because if she would have that courage then she should fought for her love but actually she is a so called….BITCH.
